JOB OVERVIEW

Scope of Work
We are a U.S. Healthcare-based company seeking an expert in Philippine labour law and human resources to produce a comprehensive guide/checklist covering the following:
-How to determine whether a worker in the Philippines should be engaged as a contractor (independent contractor) vs. an employee, under Philippine law.
-A checklist for engaging someone in the Philippines as a contractor: what must be done to comply (from U.S. company perspective + Philippine perspective).
-What documents need to be collected and retained for on?boarding a contractor in the Philippines (e.g., ID, passport, tax registration, local business registration if applicable, contract for services, etc.).
-How to establish a Philippine entity (or outsource structure) so our U.S. company can hire or engage Philippines?based contractor(s) legally, including the steps, registration requirements, fees, entity types (branch vs subsidiary vs local contractor), and compliance obligations (tax/social security/benefits).
-Useful practical matters: hours/day, hours/week, benefits (what one must provide or not provide if truly a contractor), pay schedule (suggested best practice), and risk mitigation (what to avoid to prevent mis?classification and employer liability).
-Written guide in checklist/table format, with explanatory text, and with all major legal references (Philippine statutes/regulations/DOLE pronouncements) cited in footnotes or end?notes.
-Maintaining HIPAA compliance
BOTTOM LINE: How to on-board a contractor while maintaining compliance under Philippine law and HIPAA compliance

Deliverables
A Word or PDF document with:
Section A: Contractor vs Employee – classification overview, key criteria, legal references.
Section B: Checklist for engaging a contractor in the Philippines (step?by?step).
Section C: Documents on?boarding checklist (for contractor individual and for your U.S. company).
Section D: How to form a Philippine entity / legal vehicle, steps, entity types, compliance obligations.
Section E: Practical terms: hours/day, hours/week, pay schedule, benefits (what to provide vs what to avoid for independent contractor), POA/contract drafting tips, monitoring/control risks.
Section F: Reference appendix – list of laws/regulations with citations (government site links where available).

Budget & Timeline
Pay: USD$7 per hour, up to maximum 10 hours total (i.e., USD$70 maximum).
Timeline: Complete draft within 2 business days after contract.
Payment terms: Upon delivery of final document and acceptance.

Required Expertise
-Proven experience in Philippine labour law (especially classification of contractors vs employees) and HR compliance.
-Ability to reference Philippine laws/regulations (e.g., Labour Code, DOLE Department Orders, relevant jurisprudence).
-Experience advising foreign (U.S.) companies hiring in the Philippines is a plus.
-Good English and ability to provide a clear, structured checklist format.
